Privacy policy

Introduction

SENDIT NZ Limited (SENDIT NZ, we, us, our) complies with the New Zealand Privacy Act 2020 (the Act) when dealing with personal information. Personal information is information about an identifiable individual (a natural person).

If you access or use our mobile app (App), our website, including all subdomains on our website (Website) and/or any other services of ours (together with the App and the Website, Services), you authorise us to collect and use your personal information in accordance with this policy and the Act.

This policy sets out how we will collect, use, disclose and protect your personal information. This policy applies to all users of our Services, including individuals who use the Services to arrange for the transport of Items, and other persons with whom we deal directly or indirectly, whether via the App or Website, or otherwise.

This policy does not limit or exclude any of your rights under the Act. If you wish to seek further information on the Act, see www.privacy.org.nz.

This policy was drafted with brevity in mind. It does not provide exhaustive details of all aspects of our collection and use of personal information. We are happy to provide any additional information or explanation. Any requests for further information should be sent to privacy@senditnz.com.

You do not have to give us any information or provide us with full information. But if you do not, we may refuse or be unable to provide you with all or part of the Services.

Unless otherwise defined in this policy, any capitalised term used in this policy has the meaning given to it in our Terms of Use (Terms of Use).

Changes to this policy

We may change this policy by uploading a revised policy onto the Services. The change will apply from the date that we upload the revised policy.

CHILDREN

We do not intend to collect personal information from or about children under 16. If you have reason to believe that we have collected personal information from or about a child under 16, please contact us at privacy@senditnz.com.

All Users must be at least 18 years of age to create an account on, and use, the Services.

When does this Privacy Policy apply

This policy sets out how we will collect, use, disclose and protect your personal information when you visit and use the Services, and any related services we offer, or when you otherwise deal with us or a user of the Services.

If you provide your personal information to any other User (for example, if you provide personal information in the course arranging via the Services for the transportation of any Items), that other User may have its own policy relating to your personal information. We cannot control, and are not responsible for, how any other User uses your personal information.

WHAT PERSONAL INFORMATION DO WE COLLECT

Directly

We collect the following information from you.

When you register to become a User or update your User account details, or when you otherwise acquire services from us, we collect your name, email address, phone number, address and any other personal information you provide to us, including a photo to use for your User profile.

When you register to become a Deliverer or update your account details as a registered Deliverer, in addition to the information described above, we also collect your photo, a copy of your driver's licence, your driver's licence details, a copy of evidence of your address, and any other identity and address verification evidence you provide to us for the purpose of registering as a Deliverer or keeping your Deliverer account details up to date.

If you use any chat, message, review or rating function to input Content via the App or any other Service, we collect the information in those messages.

If you contact us via any other method, or for any other reason, including by subscribing to any newsletter or other marketing communication of ours, we collect the information you provide to us.

We need access to your location when you are confirming the pick-up and drop-off of Items as part of a Job you are involved in (including in connection with photos captured of those Items).

If we bill you for Fees or otherwise collect money that you owe us in accordance with our Terms of Use or Deliverer Agreement, we collect your invoicing/billing address, email address, service description, and any other information you submit to us for billing purposes.

If you contact us about a User Dispute, we collect the information you provide to us in connection with that User Dispute.

If you submit a request in connection with the SENDIT Protection Pool, we collect any information you provide to us for the purposes of that request.

If we are required to do so under applicable law, including the Anti-Money Laundering and Countering Financing of Terrorism Act 2009, we may require you to provide to us certain personal information including information about, and evidence confirming, your identity, your address, your transaction activity, and other customer due diligence information required under that Act.

Some of the personal information that we collect directly from you may be mandatory and some may be optional. We will let you know which of these applies at the time we collect the relevant personal information. While you do not have to provide us with any of the information that we may request, this might mean that we cannot provide all or part of our services to you, or they may not perform as well as they should. If you require further information about the consequences of not providing us with any personal information, please contact us at privacy@senditnz.com.

If possible, we will collect personal information from you directly.

Indirectly

We collect personal information from our Users when they use the Services. For example:

Deliverers take a photo of the relevant Items they have agreed to deliver for a Sender at pick-up, and then at drop-off. Those photos are then uploaded by the Deliverer into the App. If any personal information is included in those photos, we collect that personal information indirectly via the relevant Deliverer

we collect and store the details of pick-up and drop-off locations, and the details of any person to be involved in the picking-up or dropping-off of Items as part of a Job (including any person who is not themselves a User). We do that for the purpose of confirming pick-up and delivery, fraud prevention and to assist with the resolution of any disputes

if a User uses any message, review or rating function to input Content via the App or any other Service, we collect the information in those messages, including any personal information where the information in those messages includes personal information.

The Services may include functionality that allows you to connect your individual User account to an organisation User's account (if you use the Services as an officer, employee, consultant, contractor or agent of that organisation, for example). If that happens, we collect any information that the administrator of that organisation User's account, or any other User whose account is also connected to that organisation User's account, provides to us.

When another User contacts us about a User Dispute involving you, we collect any information they provide to us in connection with that request.

When another User submits a request in connection with the SENDIT Protection Pool in relation to a Listing or Job that involved you (or that the other User thinks involved you), we collect any information they provide to us for the purposes of that request.

Automatically

When you access and use the App, our other Services, or any of our related services, we may automatically collect information about your device and usage of our website, App, Services, and other services, including your IP address and/or other device identifying data, time spent on certain pages of the website, pages visited, and links clicked.

Some of this data is collected through third party tools and/or the use of cookies, web beacons and similar storage technologies. Please refer to our cookie policy set out below for more information on our use of cookies.

We use Sentry for error monitoring and crash reporting services. Sentry collects technical and diagnostic information (including device type, OS version, app version, crash logs, and IP address for approximate location only) to help monitor the stability and performance of the App. You can learn more about Sentry, and read its privacy policy, at https://sentry.io/privacy/.

From public sources and other third parties

We may collect personal information about you that is publicly available, including using third party sources (e.g. data brokers and providers of natural language processing and artificial intelligence services) to collect and supply to us that publicly available personal information.

We may otherwise collect personal information about you from third parties where you have consented to, or authorised, this.

We may link personal information collected from public sources and other third parties with personal information supplied by you, made available to us indirectly, or supplied automatically.

3rd Party Payment Provider

Payments in connection with the Services are processed independently by the 3rd Party Payment Provider. At the date this policy was last updated, the 3rd Party Payment Provider is Stripe. We use Stripe for payments services. Stripe collects and processes personal data, including via cookies and similar technologies. The personal data Stripe collects may include transactional data and identifying information about devices that connect to its services. Stripe uses this information to operate and improve the services it provides to us and to Users, including for fraud detection, loss prevention, authentication, and analytics related to the performance of its services. We do not have access to, or store, your full credit or debit card information or banking credentials. We receive limited payment-related information from the 3rd Party Payment Provider for the purpose of operating the Services (e.g. for reconciliation, dispute handling, compliance and other Service-related operations). That limited information includes transaction amounts, payment status information, timestamps and identifiers associated with payments.

SENDIT Pro subscriptions

If you subscribe to SENDIT Pro, we and the 3rd Party Payment Provider collect and process personal information relating to your subscription, including Stripe Customer, Subscription, invoice and payment identifiers and metadata; subscription status and billing period information; and payment method details held by Stripe (we do not store your full card details).

We use this information to process subscription payments; administer your Pro entitlement; provide invoices and payment-method management; manage cancellation; prevent duplicate or fraudulent subscriptions; and support billing disputes and enquiries.

Stripe remains an independent third-party payment provider. See the 3rd Party Payment Provider section above and Stripe's privacy policy for further information.

You acknowledge and agree that any credit card and billing and payment information that you provide to us may be shared by us with companies who work on our behalf, including payment processors for the purposes of effecting payment to us or to other Users, and servicing your account.

How we use your personal information

We will use your personal information:

to verify your identity and otherwise create, maintain and manage your account with us

to consider and verify your eligibility to be registered as a Deliverer (where applicable)

to provide the App, the other Services, and any of our other services to you or to a business that you work in or with, and to other Users

to check the contents of any Listing or other Content

to enable Users to communicate with each other

to enable Users to exercise their rights and perform their obligations in connection with any Job they are involved in

to meet the purpose for which a person provided the information, including any purpose described in or contemplated by the Terms of Use or Deliverer Agreement

to notify you of the progress of any Listing, quote/offer, Job, or payment in connection with your use of the Services

if you are registered as a Deliverer, to notify you of available Listings in your area or in the area you have indicated an interest in responding to Listings

to update you about any changes to the Services, to the Terms of Use or Deliverer Agreement, to this policy or to any other policy or guideline affecting the Services

to investigate and/or enforce any actual or suspected breach of (i) the Terms of Use, the Deliverer Agreement or our policies and guidelines relating to the Services, (ii) the law, or (iii) our rights or any third party's rights

to exercise our rights under the Terms of Use and/or Deliverer Agreement, including to review, monitor, remove or edit any Content in the circumstances contemplated by the Terms of Use and/or Deliverer Agreement

to prevent fraud and to ensure the security and integrity of our Underlying Systems

to comply with our obligations under applicable law, including the Anti-Money Laundering and Countering Financing of Terrorism Act 2009. For example, we are required to monitor transaction activity through the Services and we may be required to report to third parties, subject ourselves to third party audits, and record and verify a User's identity and other information

to consider and review, and communicate with the people involved in, any request under the SENDIT Protection Pool

to consider, review, and/or resolve any disputes, including any User Dispute or any dispute between a person and us (including communicating with the people involved and enabling the people involved to communicate with each other)

to market our services to you, including contacting you electronically (e.g. by text, phone or email for this purpose)

to request feedback on the Services from you, including contacting you electronically (e.g. by text, phone or email for this purpose)

to monitor, analyse and address errors and technical, performance and security issues

to improve the Services and any other services that we provide to you, and to improve the user experience related to that, including to enable us to identify new users. To do this, we may analyse how you interact with the App or the Website

to collect our Fees or any other money that you owe us, or that the organisation whose account you are connected to owes us (if applicable)

to process SENDIT Pro subscription payments, administer Pro entitlement, manage subscription cancellation, and support billing disputes (where applicable)

to facilitate the collection, payment and (if applicable) refund of money between Users in connection with Jobs, or to process any payment under the SENDIT Protection Pool, including verifying and processing details for any collections, payments and refunds of that kind

to respond to communications from you, from the organisation whose account you are connected to (if applicable), or from any other User, including complaints and enquiries

to conduct research and statistical analysis (on an anonymised basis)

to protect and/or enforce our legal rights and interests, including checking your compliance with the Terms of Use, Deliverer Agreement or any policy or guideline relating to the Services, enforcing our agreements with Users or any third party, defending any claim, and reviewing the content of any communication made available via the Services by any method

to assist in maintaining the safety, security and integrity of the Services

to respond to lawful requests by public authorities, including to comply with law enforcement requirements or requests

to work with you as a commercial partner (where applicable)

for any other purpose authorised by you or applicable law (including the Act).

We may transfer your personal information in the case of a sale, merger, consolidation, liquidation (or similar insolvency process), reorganisation or acquisition of our business.

If you receive any marketing emails from us, you can stop those emails at any time by following the unsubscribe instructions included in those emails, or by contacting us at privacy@senditnz.com.

PERSONAL INFORMATION INCLUDED IN LISTINGS, Reviews, messages, and other communications

When you create a profile in the Services, and if you add a Listing, a review or any other message that is generally available to other Users of the Services, the information that you include in that profile, Listing, review or other message will be available to those Users. You should ensure that, when setting up your profile and any Listing or other communication of that kind, or when a person is doing so on your behalf, the profile, Listing or other communication only includes information that you wish to be available to other Users.

If you participate in any chat, messaging or other communication service made available via the App or other Services, the information that you include in those communications will be available to us and to third parties, including any recipient of that message and any provider of intermediary communication services. You should ensure that, when using any chat, messaging or other communication service, your messages only include information that you wish to be available to other people.

Please exercise caution when choosing when, and how much, personal information about yourself or another person you share voluntarily when using the Services.

We do not accept any responsibility to monitor all communications made via the Services, but we reserve the right to access, monitor and review those communications, regardless of whether or not they are generally available to Users on the Website or the App, in the circumstances and for the purposes described in the Terms of Use.

Disclosing your personal information

We may disclose your personal information to:

other Users in the circumstances described in, or otherwise contemplated by, the Terms of Use or as otherwise reasonably contemplated by your use of the Services (including your profile photo, any personal information you include in your profile, your Listings, and any ratings or reviews you input into the Services or that are written about you)

if there is a User Dispute, or if a User contacts us about a dispute, we will share the details of the dispute and the contact details of the relevant Users, between the Users who are parties to that dispute in the manner contemplated by the Terms of Use

any other person involved in a Listing or Job who is not a User themselves. For example, a third party recipient of any Items to be transported in connection with a Job, or a third party responsible for handing Items over to a Deliverer on pick-up

if the Services allow you to connect your individual User account to an organisation User's account and you do so, we may also disclose your personal information to any person we believe to be an authorised representative of that organisation. If you have questions about that organisation's access to, and use of, your personal information, please contact the relevant person in that organisation

another company within our corporate group

the 3rd Party Payment Provider

any business that supports the Services, or any other services we make available to you or other Users, including any person that provides error monitoring and crash reporting services, and any person that hosts or maintains any underlying IT system or data centre that we use to provide the Services or those other services

third parties (for anonymised information, whether statistical or otherwise)

professional advisers, e.g. accountants, lawyers or auditors

a person who can require us to supply your personal information (e.g. a regulatory authority or a law enforcement agency)

any other person with your consent

any other person where reasonably necessary to fulfil a request you have made of us, including any request under the SENDIT Protection Pool

any other person in the case of a sale, merger, consolidation, liquidation (or similar insolvency process), reorganisation or acquisition of our business

any other person where we are authorised or required to do so by applicable law, including in connection with our obligations under the Anti-Money Laundering and Countering Financing of Terrorism Act 2009

any other person if we believe in good faith that it is necessary for investigating, and/or enforcing, any actual or suspected breach of (i) the Terms of Use, the Deliverer Agreement or any policies and guidelines relating to the Services, (ii) the law, or (iii) our rights or any third party's rights.

international TRANSFERS OF PERSONAL INFORMATION

The 3rd Party Payment Provider and our provider of error monitoring and crash reporting services are each located outside of New Zealand (the country where SENDIT NZ is incorporated). Other businesses that support the Services may also be located outside of New Zealand and outside of the country where you are located. This means your personal information is held and processed outside New Zealand. The disclosure of your personal information to a country outside New Zealand may take place where (i) we believe on reasonable grounds that the recipient is subject to privacy laws that, overall, provide comparable safeguards to those in the Act; (ii) we believe on reasonable grounds that the recipient is subject to privacy laws of a country prescribed under the Act; or (iii) we otherwise believe on reasonable grounds that the recipient is required to protect the information in a way that, overall, provides comparable safeguards to those in the Act (for example, under an agreement entered into between us and the recipient).

The App and other Services utilize cloud infrastructure that relies on services based in different regions globally. At the date this policy was last updated, we use Supabase for database, authentication and storage services, and Firebase for notifications and related services. Both Supabase and Firebase process data through secure servers located in multiple regions globally, including North America, Europe, Asia, Australia and South America. This means that the personal information we collect is held and processed in countries outside of New Zealand and may be held and processed in countries outside of the country where you are located.

Protecting your personal information

We will take reasonable steps to keep your personal information safe from loss, unauthorised activity, or other misuse.

Accessing and correcting your personal information

Subject to certain grounds for refusal set out in the Act, you have the right to access your readily retrievable personal information that we hold and to request a correction to your personal information. Before you exercise this right, we will need evidence to confirm that you are the individual to whom the personal information relates.

In respect of a request for correction, if we think the correction is reasonable and we are reasonably able to change the personal information, we will make the correction. If we do not make the correction, we will take reasonable steps to note on the personal information that you requested the correction.

If you want to exercise either of the above rights, email us at privacy@senditnz.com. Your email should provide evidence of who you are and set out the details of your request (e.g. the personal information, or the correction, that you are requesting).

We may charge you our reasonable costs of providing to you copies of your personal information or correcting that information.

Internet use

While we take reasonable steps to maintain secure internet connections, if you provide us with personal information over the internet, the provision of that information is at your own risk.

If you include your personal information in your profile, a review, Listing, or other communication via the Services that is visible to other Users on the App or the Website, you acknowledge and agree that the information you post is available to other Users.

If you include your personal information in any communication that is not generally visible to other Users on the App or the Website, you acknowledge and agree that the person to whom that communication is addressed (and any other person who might reasonably be expected to receive that communication as contemplated by this privacy policy or the Terms of Use) will receive that information and may share it with others. You also acknowledge and agree that we reserve the right to monitor communications made via the Services in accordance with the Terms of Use.

If you follow a link in the App or on the Website to another website (including to the 3rd Party Payment Provider), the owner of that website will have its own privacy policy relating to your personal information. We suggest you review that website's privacy policy before you provide personal information to that owner or website.

DATA Retention policy

The personal information that we collect and use will not be kept longer than necessary for the purposes for which it is collected, or for the duration required for compliance with applicable law, whichever is longer. We may use any aggregated or anonymous data derived from your personal information after your personal information itself is no longer retained by us, but not in a manner that would identify you personally.

COOKIES

We may use cookies (an alphanumeric identifier that we transfer to your computer's hard drive so that we can recognise your browser, in the case of web cookies, or that are installed directly on your device and run locally, in the case of mobile cookies) to monitor your use of the Website or the App. You may disable cookies by changing the settings on your browser and your device, although this may mean that you cannot use all of the features of the Website or the App.
